Agreement to Terms
These Terms and Conditions (“Terms”) govern your use of the website at aestive.digital (“Site”) and any services provided by Aestive Digital, operated by Sharjeel Faiq (“we,” “us,” “our”). By accessing this Site or engaging our services, you agree to be bound by these Terms. If you do not agree, do not use this Site or engage our services. We reserve the right to update these Terms at any time — continued use of the Site or services constitutes acceptance of any changes.
Services
Aestive Digital provides the following services to med spas, aesthetic clinics, and related businesses:
- Website design (UI/UX design for aesthetic clinic websites)
- Website development (custom Next.js front-end and full-stack development)
- SEO services (local SEO, technical SEO, on-page optimisation)
- Website maintenance (ongoing updates, performance monitoring, security patches)
- AI automation (lead follow-up, appointment reminders, intake form automation)
The specific scope, deliverables, timeline, and pricing for each engagement are defined in a separate project agreement, proposal, or invoice issued prior to work commencing. These Terms apply in addition to any project-specific agreement.
Project Engagements
Work begins only after receipt of the agreed deposit (typically 50% of the total project fee) and written confirmation of project scope. “Written confirmation” includes email, WhatsApp message, or signed proposal.
Client responsibilities:You agree to provide all required materials (content, images, brand assets, credentials, and feedback) within agreed timeframes. Delays caused by late content or feedback may affect delivery timelines and are not grounds for a refund or dispute.
Revisions:Each project includes a defined number of revision rounds as stated in the project proposal. Revisions are defined as changes within the original agreed scope. Scope changes requested after design approval may incur additional charges.
Approval and sign-off:Final payment is due upon project approval or launch, whichever occurs first. Providing written approval (email or message) of the final deliverable constitutes formal sign-off and releases us from further obligation to make additional changes under the original project fee.
Intellectual property:Upon receipt of final payment in full, full ownership of the website design and code is transferred to the client. We retain the right to display the completed project in our portfolio and case studies, unless explicitly agreed otherwise in writing.
Payment Terms
- All prices are quoted in USD unless otherwise stated
- A deposit of 50% is required before project commencement
- Remaining balance is due upon project completion and prior to deployment of the live website
- For ongoing services (maintenance, SEO, AI automation), invoices are issued monthly and due within 7 days of issue
- Late payments beyond 14 days may result in work being paused until outstanding amounts are settled
- We do not offer payment plans unless explicitly agreed in writing prior to kickoff
Cancellations
If you cancel a project after work has commenced, the deposit is non-refundable. If cancellation occurs after 50% or more of the project scope has been completed, the full project fee may be due. We will provide all work completed to the date of cancellation.
Agency-initiated cancellation:We reserve the right to decline or terminate an engagement at any time if: the project requirements fall outside our service capabilities, client communication becomes abusive or unreasonable, or continued engagement would cause legal or reputational risk. In such cases, a pro-rated refund of the deposit will be issued for work not yet commenced.
Warranties and Disclaimers
- Websites will be delivered with a PageSpeed score of 95+ (Lighthouse) on desktop
- All websites are deployed with HTTPS, mobile-responsive design, and submitted to Google Search Console on launch day
- SEO services follow Google’s published guidelines and best practices
- Specific search engine rankings — Google’s algorithm changes are outside our control and ranking results cannot be guaranteed
- Specific revenue outcomes, booking volumes, or business results — client results shown on our website represent outcomes achieved and are not guarantees of future performance
- Uptime or performance of third-party services (booking platforms, CRMs, payment gateways) integrated into your website
All services are provided “as is” to the extent permitted by law. We disclaim all implied warranties not expressly stated in these Terms.
Limitation of Liability
To the maximum extent permitted by applicable law, Aestive Digital’s total liability to you for any claim arising out of or related to our services shall not exceed the total fees paid by you in the three months preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of revenue, loss of data, loss of business, or reputational harm.
Confidentiality
Both parties agree to keep confidential any proprietary information, business data, or trade secrets shared during the engagement. We will not disclose your clinic’s internal data, patient information, or business metrics to any third party without your explicit written consent. This obligation survives termination of the engagement.
Third-Party Tools and Integrations
Our services may involve integration with third-party platforms (Jane App, Mindbody, Acuity, Calendly, Zoho CRM, Stripe, etc.). We are not responsible for the terms, pricing changes, availability, or functionality of these third-party services. Any costs associated with third-party platform subscriptions are your responsibility unless explicitly included in the project scope.
Governing Law
These Terms are governed by the laws of Pakistan, where Aestive Digital is operated. For clients in the United States, United Kingdom, or UAE, any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to binding arbitration under the rules of the relevant jurisdiction. Nothing in these Terms limits your statutory rights as a consumer or business under applicable local law.
Portfolio Rights
Unless you request otherwise in writing before project commencement, you grant us a non-exclusive, royalty-free licence to display your completed website, screenshots, and associated metrics (with your approval) in our portfolio, case studies, and marketing materials. This licence does not include patient data, internal business financials, or any sensitive information.
